Sec. 86-178  Common off-street parking areas.

A single use encompassing more than one of the activities, as specified in section 86-175, or two or more principal uses whether located on the same or separate lots, may utilize a common area in order to comply with off-street requirements, provided that the total number of individual spaces available in such common areas is not less than the sum of the spaces required for the individual uses as separately computed in accordance with the provisions of section 86-175, and provided that the owner of the lot relinquish his development rights over the property until such time as parking space is provided elsewhere.

Proposed Change
Sec. 86-178  Common off-street parking areas.

            A single use encompassing more than one of the activities, as specified in section 86-175, or two or more principal uses whether located on the same or separate lots, may utilize a common area in order to comply with off-street requirements, provided that the total number of individual spaces available in such common areas is not less than the sum of the spaces required for the individual uses as separately computed in accordance with the provisions of section 86-175, and provided that the owner of the lot relinquish his development rights over the portion of the lot that is necessary to provide sufficient individual parking spaces to meet off street requirements for all uses of the common area for parking property until such time as the common use ceases.

            Comment: the impact of the changed ordinance is to relieve the owner of the requirement to relinquish development rights on the portion of the lot not required for common use parking and to define the time at which development rights are restored to the owner.

            Status: This ordinance has passed first reading by Town Council and will proceed to public hearing.
