No. 2009 - 19 TOWN OF EDISTO BEACH AN ORDINANCE TO ESTABLISH CHAPTER 19 OF THE CODE OF ORDINANCES WHEREAS, the Town Council of the Town of Edisto Beach believes that it is in the best interest of the Town to enact Chapter 19 entitled “Alcoholic Beverages” so as to provide for the operating hours of business establishments that sell alcoholic beverages. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Edisto Beach, South Carolina, in council duly assembled that Chapter 19 of the Code of Ordinances be and is hereby enacted, which shall read as follows: Chapter 19 ALCOHOLIC BEVERAGES Sec. 19-1. Hours of operation for on-premises establishments. All business establishments selling beer, wine, liquors, or other alcoholic beverages, as defined by S.C. Code of Laws Sec. 61-6-20, as may be amended from time to time, for on-premises consumption shall observe the hours of operation as set forth in paragraph (1) below. Any operators or owners of such establishments, as may be determined from the business license issued to such establishments, found in violation of this section shall be subject to punishment as provided in the city business license ordinance and this Code and shall be subject to having their business license revoked, other penalties imposed, and/or their establishment declared a nuisance. (1) Hours of operation. TABLE INSET:
*Establishments serving alcoholic beverages after midnight Saturday, during any Sunday hours, and after midnight Sunday, but before 6:00 a.m. Monday, must have first obtained the necessary permits or licenses from the state department of revenue, or that department's designee. (2) Exception. The Town Council, in its absolute discretion, may authorize an exception to the hours of operation requirements for temporary special events upon written application by the operator or owner of such establishment, provided that the written application is received by the Town at least 45 days before the event. (3) Violations and penalties. Nothing in these provisions shall supersede federal or state laws regulating the hours of sale of alcoholic beverages for on-premises consumption. It shall be unlawful for any on-premises establishment to remain open outside of permitted hours of operation. Penalties shall be as set forth above as well as under section 1-6 of this Code.
This ordinance shall take effect 30 days after adoption so as to provide the business establishments the opportunity to make any necessary adjustments.
