No. 2009 - 26 TOWN OF EDISTO BEACH AN ORDINANCE TO AUTHORIZE THE EXECUTION OF QUIT CLAIM DEEDS TO RESOLVE THE CATHERINE STREET BEACH ACCESS DISPUTE WHEREAS, Joseph T. Sumrall, Jr. and Jeffre W. Sumrall (herein “Sumralls”) claim ownership of a contested strip of land known as the Catherine Street Beach Access by virtue of a deed from David A. Sharp and Susan C. Sharp dated May 30, 2003, and recorded in the R.O.D. Office for Colleton County in Deed Book 1017 at Page 208, and the chain of deeds going back to a Quit Claim Deed from Sea Island Resorts, Inc., dated 4 June, 1976, and recorded on April 12, 1982 , in Book 243, at Page 73, in the Register of Deeds Office for Colleton County, South Carolina; and WHEREAS, the Town of Edisto Beach (herein “Town”) also claims ownership of a part of the below described property by virtue of a deed from Sea Island Resorts, Inc. to the Town of Edisto Beach, Colleton County, South Carolina dated March 10, 1983 and recorded in the Register of Deeds Office for Colleton County in Deed Book 260 at Page 229; and WHEREAS, the Sumralls are also the owners of certain property known as Lot 1, Block DD, Edisto Beach, South Carolina, which lot is included in the below described property; and WHEREAS, the Town and the Sumralls are desirous of resolving with finality the ownership of the contested strip of land by dividing same into two (2) equal parts with the Sumralls receiving the ownership of the strip designated as Beach Access and the other one-half (1/2) of the strip being added to as a part of Lot 1, Block DD owned by the Sumralls without any restrictions or limitations or reservations thereon; and WHEREAS, the Town is vested with the authority to execute the transfers by South Carolina Code of Laws Section 5-7-260; and WHEREAS, the Town Council believes that it is in the best interests of the citizens of the Town of Edisto Beach and the general public to resolve the matter as herein provided. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Edisto Beach, South Carolina, in council duly assembled that the Mayor and Town Attorney are hereby authorized to effect the resolution of the Catherine Street Access dispute by dividing same into two (2) equal parts with the Sumralls receiving the ownership of the strip designated as Beach Access and the other one-half (1/2) of the strip being added to as a part of Lot 1, Block DD owned by the Sumralls without any restrictions or limitations or reservations thereon and the Mayor is authorized to execute all documents and Quit Claim deeds necessary to effect the transfer.
