AN ORDINANCE

TO AMEND SECTION 86-254 (d) OF THE TOWN’S CODE RELATING TO SUSPENDING THE TOWNS’ TREE ORDINANCE DURING A DECLARED “STATE OF EMERGENCY

 

WHEREAS, the Planning Commission of the Town of Edisto Beach has recommended to the Town Council that Section 86-254 (d) of the Town’s Code be amended; and

WHEREAS, the Town Council believes it is in the best interest of the Town to enact the amendment; and

WHEREAS, prior to the final reading of this ordinance a public hearing was held pursuant to the requirements of the S.C. Code of Laws.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Edisto Beach, South Carolina, in council duly assembled that Section 86-254 (d) of the Town’s Code be amended, which shall read as follows:

 

Sec. 86-254.  Removal of certain trees prohibited.

 

(d)   During the period of an emergency, such as tornado, hurricane, ice storm, flood, or any other act of nature, the requirements of this article shall be waived from the time as such the Mayor has declared a “State of Emergency”. In such case, the cutting and removal of felled trees shall be permitted until such time as the Mayor has rescinded the “State of Emergency”.

 

This ordinance shall take effect upon final reading.
